REQUEST FOR ENGINEERING PROPOSALS –

PUBLIC NOTICE

(Class II legal notice published September 11 and September 18, 2019)

The City of Charles Town, West Virginia is seeking qualified engineering firms to primarily help the city evaluate its existing stormwater management system, prepare cost estimates, design engineering solutions, provide pre-construction services, prepare funding packages for public and/or private financing, manage stormwater management projects, and provide technical assistance services for other high-priority engineering projects.  

Professional services to assist the city may include some or all of the following:  (1) feasibility studies, (2) cost estimates and technical assistance preparing design/build eligible applications, (3) design services to meet all federal, state, and local regulations, (4) preparation of bid and contract documents, (5) participation in the evaluation of bids, (6) monitoring and inspecting construction activities on a daily basis to ensure compliance with plans and specifications, (7) construction management and engineering consulting services, and (8) reviewing plans.  

Procurement of services shall be in accordance with West Virginia Code Chapter 5G.  Experience with stormwater evaluation, design, and build services in West Virginia is required.  Familiarity with MS4 requirements and Chesapeake Bay stormwater standards are also preferred.  No grant awards are anticipated; however, firms should be familiar with the Uniform Administrative Requirements, Cost Principles and Audit Requirements for Federal Awards.

All consultants interested in being considered must submit a proposal detailing qualifications, technical expertise, management and staffing capabilities and related experience.  The object of the competitive process is to objectively select the firm that will provide the highest quality of service.  Accordingly, technical qualifications and experience will be weighed heavily.  Selected respondents will be interviewed, and the firm judged most qualified will be selected.

While not a primary source, attention is directed to the fact that funding sources for the proposed projects may include, but not be limited to, the West Virginia Infrastructure Council, the Economic Development Administration, the Appalachian Regional Commission, and others.  All work will be performed in accordance with the regulations issued by these respective agencies and the State of West Virginia as pertaining hereto.  The selected firm will be required to comply with all applicable federal, state, and local laws and regulations, including but not limited to, the Civil Rights Act of 1964, Executive Order 11246, conflict of interest requirements, and access to records provisions, as applicable.

The Jefferson County Commission has scheduled a Public Hearing on the proposed text amendment to the Jefferson County Zoning and Land Development Ordinance, File #ZTA19-01. The text amendment, in accordance with WV Code §8A and Article 12 of the Zoning Ordinance, proposes revisions to Article 2, Definitions; Article 8, Supplemental Use Regulations; and Appendix C, Principal Permitted and Conditional Uses Table. The purpose of this amendment is to develop provisions for a Special Event Facility in the Rural, Residential Growth, and Village Zoning Districts. The new text would replace the existing Rural Event Facility provision in Section 8.14. Currently, Section 8.14 allows event facilities to locate within an existing structure. The proposed text would allow a new structure to be constructed for the purpose of establishing an event facility.

As required by §64-51-9 of the Bureau for Public Health Legislative Rule, Health Departments are required to advertise to make the public aware and receive public comment regarding proposed fees for its services.

The Jefferson County Health Department is proposing to increase the Reinspection Fee currently charged from $35.00 to $75.00.  The starting salaries for Sanitarians have increased 67% and this rate increase is necessary to support the current salaries.

Also proposed is a late fee of 25% of the unpaid Fee for all expired permits listed in 64CSR30 to be applied when a payment is not received within 10 days of the expiration date.  This fee will be utilized to offset the additional cost incurred in collecting late fees.

PUBLIC NOTICE OF LUC IMPLEMENTATION AND UECA SITE CLOSURE

PUBLIC NOTICE DATE: September 11, 2019

The Office of Environmental Remediation (OER) at the West Virginia Department of Environmental Protection (WVDEP) has approved Land Use Covenant (LUC) implementation and site closure at 7-Eleven Store #10673 under the Uniform Environmental Covenants Act (UECA).  The applicant, The Southland Corporation (7-Eleven, Inc.), has been working with the WVDEP since negotiating a UECA Agreement on January 20, 2011.

Site Location/Description:  7-Eleven Store #10673, 110 South Mildred Street, Ranson, Jefferson County, West Virginia consists of approximately 0.34 acres of land and a commercial building (retail petroleum sales and convenience store). Several underground storage tanks (USTs) containing gasoline have been in use at the site, including: a 10,000-gallon single-walled containing regular unleaded (RUL) gasoline and one 10,000-gallon single-walled UST containing premium unleaded (PUL) both installed in 1976 and one 6,000-gallon single-walled fiberglass UST installed in 1985. In March 2000, the 10,000-gallon single-walled RUL UST was taken out of service due to a suspected and later confirmed leak from the tank.  In April 2000, drilling at the site confirmed the presence of liquid-phase hydrocarbons (LPH) in the subsurface at which time the WVDEP assigned Leak No. 00-031.

Environmental History/Remediation: In March 2001, during UST removal and replacement activities, approximately 340 tons of petroleum-contaminated soil was removed from the tank excavation and disposed off-site.  Between 2000 and 2002, a series of subsurface investigations were conducted to delineate the extent of the petroleum release on the site and in areas off-site.  Between 2002 and 2010, remedial activities consisting of ozone injection, soil vapor extraction (SVE), high vacuum extraction and groundwater pump and treat were conducted at the site.  The initial SVE system removed over 1,680 pounds of total hydrocarbons.  In 2002, three high vacuum extraction events removed approximately 4,800 gallons of water and LPH from on-site and nearby off-site monitoring wells.  Between 2000 and 2014, groundwater sampling was conducted at the site.  Since 2001, benzene concentrations in groundwater have shown an order of magnitude (90% by mass) decrease in on-site and off-site wells and a decrease in concentration of over 99% in several impacted wells.  In 2010, the groundwater remediation system was shut down with WVDEP approval.  Post-remedial groundwater monitoring continued at the site until 2014 at which time the groundwater monitoring wells were properly abandoned. The site investigation and the remediation activities for Leak No. 00-031 have been conducted in accordance with work plans approved by the WVDEP and the signed “Agreement for Investigation and Remediation Activities” under W. VA. Code §22-17 & §22-22B and is considered complete. 

Contaminants of Concern: Contaminants of concern at the site include benzene, methyl-tert-butyl-ether (MTBE), naphthalene and trichloroethylene (TCE). Note TCE is not considered a site-related contaminant but is from an off-site unknown source.  

Environmental Management/Future Use:  The site is serviced by a public water supply system and therefore, site groundwater is not used as a drinking water source. The extraction of groundwater for any purpose from the subsurface and the use of site groundwater for drinking water purposes is currently prohibited. This groundwater extraction/withdrawal restriction is already in-place and is being enforced by a Jefferson County Health Ordinance.  The LUC is being placed upon the site (entire property) to protect and reduce risk to a future residential user from potential vapor intrusion due to the presence of naphthalene in groundwater which poses an unacceptable risk.  Prior to any change in future site use, the LUC will require that: 1) further revaluation of the vapor intrusion pathway be conducted prior to any residential building construction (i.e., soil gas sampling), and/or 2) future residential buildings be constructed incorporating a vapor intrusion mitigation system (i.e. vapor barrier or subslab depressurization system), and/or 3) no residential buildings may be placed on site until natural attenuation/biodegradation reduces naphthalene groundwater concentrations in MW-3 to an acceptable level, and/or 4) any further evaluation should be performed by a Licensed Remediation Specialist (LRS) or similarly qualified individual with prior notification given to the WVDEP.

In March 1999, both 10,000-gallon single-walled RUL and PUL USTs were emptied and was taken out of service due to a suspected and later confirmed leak. Gasoline sales continued using the 6,000-gallon FRP UST with MUL gasoline only.  In March 1999, the WVDEP assigned Leak No. 99-062. 

Environmental History/Remediation: In May 1999, results of an Initial Site Characterization (ISC) identified the released product was unleaded gasoline. Initial remedial activities included the removal of approximately 5,825 gallons of liquid-phase hydrocarbons (LPH) and water from the subsurface, including an estimated 3,500 gallons of LPH. In January 2000 as part of removal and replacement activities, the three UST systems were removed and replaced with two new 10,000-gallon double-walled fiberglass USTs and approximately 133 tons of petroleum-contaminated soil was removed and disposed off-site.

Between 2001 and early 2013, a series of remedial activities consisting of soil vapor extraction (SVE), groundwater pump and treat and bio-injections were conducted to remediate the gasoline release at the site.  In 2007, the SVE system was shut down as extracted soil vapor had exhibited non-detectable concentrations for BTEX (benzene, toluene, ethylbenzene, and xylenes). The groundwater pump and treat system resulted in a total average 94% reduction of benzene concentrations in groundwater. The bio-injection program was successful in decreasing petroleum contaminant (benzene and the gasoline-range organics) concentrations in off-site wells to below detectable limits. In 2008, the groundwater pump and treat system was shut down.  In total, approximately 3,787 gallons of LPH was recovered from the subsurface since remediation began. In 2009, results of post-remedial groundwater sampling in three on-site site wells indicated little to no change and/or distinct decreasing trend compared to previous sampling events but were above the WVDEP De Minimis Standards for Groundwater (DMSGW). In 2013, groundwater monitoring was discontinued and groundwater monitoring wells have been properly abandoned.

The site investigation and the remediation activities for Leak No. 99-062 have been conducted in accordance with work plans approved by the WVDEP and the signed “Agreement for Investigation and Remediation Activities” under W. VA. Code §22-17 & §22-22B and is considered complete. 

Contaminants of Concern: Contaminants of concern at the site include benzene, ethylbenzene, methyl-tert-butyl-ether (MTBE), tert-butyl alcohol (TBA), naphthalene gasoline-range and diesel-range total petroleum hydrocarbons (TPH-GRO and TPH-DRO) and total xylenes.

The extraction of groundwater for any purpose from the subsurface and the use of site groundwater for drinking water purposes is currently prohibited. This groundwater extraction/withdrawal restriction is already in-place and is being enforced by a Jefferson County Health Ordinance.  The LUC is being placed upon the site (entire property) to protect and reduce risk to a future residential user from potential vapor intrusion due to the presence of petroleum hydrocarbon contaminants in groundwater, which pose an unacceptable risk.  Prior to any change in future site use, the LUC will require that: 1) further revaluation of the vapor intrusion pathway be conducted prior to any residential building construction (i.e., soil gas sampling), and/or 2) future residential buildings be constructed incorporating a vapor intrusion mitigation system (i.e. vapor barrier or subslab depressurization system), and/or 3) no residential buildings may be placed on site until natural attenuation/biodegradation reduces petroleum contaminant concentrations in groundwater to an acceptable level, and/or 4) any further evaluation should be performed by a Licensed Remediation Specialist (LRS) or similarly qualified individual with prior notification given to the WVDEP.

Any interested person may submit written comments on the draft permit and may request a public hearing in writing within thirty (30) days of the date of this public notice. Comments or requests should be addressed to:

The public comment period begins September 11, 2019 and ends October 10, 2019.

Comments received within this period will be considered prior to issuance of the permit. Correspondence should include the name, address, and telephone number of the writer and a concise statement of the nature of the issues raised. A public hearing may be held if the Director determines there is significant public interest in one or more

issues relevant to the draft permit.
