The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges.  The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed).  The purchasers shall be responsible for payment of all real estate taxes.

Please take notice that the Shepherdstown Board of Appeals will hold a Hearing on February 18, 2020 at Town Hall, 104 North King Street, Shepherdstown, West Virginia 25443 at 6:30 p.m. to determine the appeal by Thomas W. Miller to consider “a variance for a storage shed built upon his rear lot”.  Lot 43 is in Shepherd Village and zoned PUD and is improved by a Village Home, which is known for postal purposes as 24 Shepherd Village Circle. The Shepherdstown Planning Commission considered the request on August 26, 2019 (Project Permit No. 19-26) and provided their findings in its Notice of Decision dated September 17, 2019. In its Notice of Decision the Planning Commission found that “In accordance with the final Outline Plan of Shepherd Village submitted by Shepherd East Development, LLC and subsequently approved by Town Council on May 10, 2016, each lot of the duplex and triplex cohousing Village Homes of Shepherd Village has no less than ten (10) foot side yard setback and no less than twenty (20) foot rear yard setback. The storage shed constructed on the rear of lot 43 in Shepherd Village is three (3) feet from one side yard lot line, eight (8) feet from the other and four (4) feet from the rear lot line.”. It is from these findings that the appellant seeks relief.

The City of Charles Town will hold a public hearing on Monday, February 3, 2020 at 7:00 pm, prevailing time, on the following ordinance to transfer land and other provisions relating thereto that was introduced Monday, January 6, 2020.  Any person interested may appear before the City Council of the City of Charles Town at the City Hall, 101 E.
