Being all of Lot 279, Section 1D, Breckenridge, as the same is designated and described on a plat made by Appalachian Surveys of West Virginia, LLC dated September 20, 2002 entitled “Final Plat Showing Lots 222-282, Section 1D Breckenridge”, said plat being recorded in the office of the Clerk of the County Commission of Jefferson County, West Virginia, in Plat Book 19, at Page 79, 79A, 79B, 79C, and 79D. 

This conveyance is made subject, however, to all reservations, restrictions, easements and other matters as set forth in the chain of title to the above lot, tract or parcel of land, as reasonably apparent upon a view of said parcel or tract of land, and as set forth of the plat mentioned above. Specifically, the above lot, parcel or tract of land is subject to those certain reservations, restrictions, easements, and other matters as more particularly set forth in the declaration of covenants and restrictions dated February 17, 1995, and recorded in Deed Book 799, at Page 403, and all present and future amendments thereto. Reference is made to the amendments to such declaration recorded in the aforementioned clerk`s office as follows: Deed Book 822, at Page 529 (First Amendment); Deed Book 883, at Page 171 (Second Amendment) and Deed Book 974, page 707 (Third Amendment).

Being the same property conveyed to Joseph P. Wilson and S. Janelle Wilson, husband and wife, as joint tenants with the common law right of survivorship and not as tenants in common by deed from NVR, Inc., a Virginia Corporation recorded 05/14/2004 in Deed Book 989 page 00341, in the Clerk`s Office of the County Commission of Jefferson County, West Virginia.

The aforesaid property is SUBJECT TO any and all easements, rights-of-way, conditions, covenants and restrictions of record or in existence. 

The sale of the foregoing real property will be made subject to all exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record, if any, pertaining to said real estate, subject to all matters disclosed by an examination and inspection of the property, subject to any and all unpaid taxes as recorded against said property, and to any further matters announced at said sale. The property is sold subject to an accurate survey at purchaser’s expense.

The sale of the foregoing real property will also be made expressly subject to any and all other deeds of trust, judgments, liens, and all other encumbrances of any nature whatsoever, if any, having priority over the deed of trust referred to herein.

The Trustees reserve the right to adjourn the sale, for a time, or from time to time, without further notice, by announcement at the time and place of sale describe above or any adjournment thereof. The Trustees reserve the right to reject any and all bids.

The subject property will be sold in “AS IS” condition. The Trustees shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. The Trustees will deliver a trustees’ deed to the purchaser without any covenant or warranty (express or implied) in the form prescribed by W. Va. Code §38-1-6. NOTICE OF INTENT TO CREMATE REMAINS

Notice is hereby given by City Hospital d/b/a Berkeley Medical Center of its petition to the Circuit Court of Berkeley County to cremate the remains of Kevin McCune, age 59.  If there are any family members or friends who wish to take responsibility for the remains of Mr. McCune, please contact Cindy Santmier, in Care Management at Berkeley Medical Center at 304/596-5765 by August 15, 2019.
