HOME INVESTMENT

PARTNERSHIP PROGRAM

Notice is hereby given by the Jefferson County Commission that it will hold a public hearing on Thursday, March 7, 2019 at 11:00  am, prevailing time, in the County Commission meeting room located at the Old Charles Town Library, 200 E. Washington Street, Charles Town, West Virginia. The Jefferson County Commission Chambers are accessible to persons with physical disabilities. If special arrangements need to be made to accommodate citizens in order for them to participate in the public hearing, please call Sandy Slusher McDonald, Deputy County Administrator, at 304-728-3284 to make those arrangements.

The purpose of this public hearing is to discuss the specific housing needs of Jefferson County, WV. The Jefferson County Commission is a member of the Eastern Panhandle HOME Consortium of West Virginia which consists of the City of Martinsburg, Berkeley County, part of Jefferson County and part of Morgan County, West Virginia.  The HOME Consortium is eligible to receive a HOME Investment Partnership Grant in FY 2019.  The U.S. Department of Housing and Urban Development will be notifying the City of Martinsburg in the future of the amount of HOME funds that will available for FY 2019.  In order to receive those funds, the member jurisdictions in the Eastern Panhandle HOME Consortium must develop a program for the use of HOME funds as a part of the City of Martinsburg’s FY 2019 Consolidated Annual Action Plan. The HOME Consortium will be preparing their HOME Program and they intend to afford citizens, local agencies, and interested parties the opportunity to become involved in the planning process.

The following general types of activities are eligible for funding under the HOME program:  Homeowner Rehabilitation, including repair, rehabilitation or reconstruction of owner occupied houses; Homebuyer Activities, including funds for purchase and/or rehabilitation of existing houses or new construction of houses for homebuyers; Rental Housing, including acquisition and/or rehabilitation of existing rental housing or new construction of rental housing; and Tenant Based Rental Assistance, including financial assistance for rent, security deposits and under certain conditions, utility deposits for tenants.  All HOME funds must be used for persons and households that meet the HUD income guidelines and definition of low- and moderate-income.

 Notice is also hereby given that the JEFFERSON COUNTY COMMISSION is accepting proposals for the use of its portion of the HOME Consortium funds for FY 2019 beginning January 18, 2019.  Application packets, instructions and information are available on an open basis. All interested applicants are encouraged to contact the Jefferson County Commission office, in order to obtain the application packet and to address any questions. Request for Bids

The City of Ranson, in cooperation with the West Virginia Division of Highways (WVDOH), is seeking sealed bids for the construction of an extension of West Virginia Route 68, Northport Avenue on the former Jefferson Orchard Property beginning near the intersection of Route 9 and Northport Ave. The construction project will be administered by the City of Ranson on behalf of WVDOH.  Bids must be submitted in a sealed envelope clearly marked “NORTHPORT AVENUE EXTENSION PROJECT” on the outside. Bids will be accepted until 3:00 p.m. on Monday, March 11, 2019, at Ranson City Hall, 312 S. Mildred Street, Ranson, WV 25438.

1. Northport Avenue Extension Plans, dated February 2019, prepared by The Thrasher Group, Inc.

 A mandatory pre-bid meeting will be held at 10:00 a.m. on Thursday, February 21, 2019 at Ranson City Hall, 312 S. Mildred Street, Ranson, WV 25438. The deadline for written questions is 5:00 p.m. on Monday, March 4, 2019.

 Each bid must be accompanied by a bid bond, or a certified check or a cashier’s check made payable to the City of Ranson, West Virginia as a guarantee that if the contract is awarded to the bidder, that the bidder will enter into a contract and will furnish a performance bond equal to the amount of the contract, for the faithful performance of said contract within ten (10) days of the award date. For the bid to be accepted, the bid bond must be included with the current bidding forms and shall not be less than 10% of the amount bid. All bid bonds and performance bonds must comply with the provisions of WV Code §§ 33-19-1 and 33-12-7 including the requirement regarding counter-signature of the bond by a Licensed West Virginia resident agent of the insurer. BERKELEY COUNTY PUBLIC SERVICE WATER DISTRICT

NOTICE OF PROPOSED WATER RATE INCREASE

Pursuant to WV Code §16-13A-9, as amended by a 2015 Act of the Legislature, the Berkeley County Public Service District (“District”) shall propose the adoption of a Capital Capacity Improvement Fee to be added to its existing water rates which shall undergo a first and second reading before the Public Service Board of the District and which, if approved, shall be submitted to the Berkeley County Council for final approval. The adoption of a Capital Capacity Improvement Fee is to provide funds for future capital projects necessitated by growth.

SPECIAL WATER SERVICES

1. Where water is desired for only a short period of time, and not continuously throughout the year, such as for vacation homes or cottages, building purposes, street paving, cleaning property, filling tanks or other uses of this kind, an application shall be made as set forth in Water Rule 4.1.6., and payment made in accordance with the applicable schedule of rates and charges, in which case a suitable deposit shall be made.

2.When making application for special water service, the applicant shall pay the District the (a) applicable security deposit; and (b) service reconnecting charge.

3. The applicant shall forfeit the total security deposit if the District can show the user tampered with any District property.

4.Each reconnecting of a special water service shall require a new application. 

RETURNED CHECK CHARGE

A service charge equal to the actual bank fee assessed to the District, not to exceed $25.00, will be imposed upon any customer whose check for payment of charge is returned by his or her bank due to insufficient funds.

SECURITY DEPOSIT

Not to exceed two-twelfths (2/12) if the average annual usage of the applicant’s specific customer class or fifty dollars, whichever is greater. This fee may be changed by applicable statuary provisions.

PRIVATE FIRE PROTECTION SERVICE

Where connection, hydrants, sprinklers, etc on private property are maintained by consumer.

Private Fire Protection Sprinkler systems shall pay $128.62 per year, plus $0.43 per sprinkler head, payable annually.

Hose Connections, for fire use only $74.38 per year, payable annually Simplex or Duplex

DELAYED PAYMENT PENALTY

The above schedule is net. On all accounts not paid in full when due, ten percent (10%) will be added to the net current amount unpaid. This delayed payment penalty is not interest and is to be collected only once for each bill where it is appropriate.

RECONNECTION-$20.00

To be charged whenever the supply of water is turned off for violation of rules, nonpayment of bills or fraudulent use of water.

TAP FEE

The following charge is to be made whenever the utility installs a new tap to serve an applicant. 

A tap fee of $450.00 will be charged to all customers who apply for service outside of a certificate proceeding before the Commission for each new tap to the system.

LEAK ADJUSTMENT

$0.76 per 1,000 gallons is to be used when the bill reflects unusual consumption which can be attributed to eligible leakage on customer’s side of the meter. This rate shall be applied to all such consumption above customer’s historical average usage.

SPECIAL WATER SERVICES

1. Where water is desired for only a short period of time, and not continuously throughout the year, such as for vacation homes or cottages, building purposes, street paving, cleaning property, filling tanks or other uses of this kind, an application shall be made as set forth in Water Rule 4.1.6., and payment made in accordance with the applicable schedule of rates and charges, in which case a suitable deposit shall be made.

2.When making application for special water service, the applicant shall pay the District the (a) applicable security deposit; and (b) service reconnecting charge.

3. The applicant shall forfeit the total security deposit if the District can show the user tampered with any District property.

4.Each reconnecting of a special water service shall require a new application. 

RETURNED CHECK CHARGE

A service charge equal to the actual bank fee assessed to the District, not to exceed $25.00, will be imposed upon any customer whose check for payment of charge is returned by his or her bank due to insufficient funds.

SECURITY DEPOSIT

Not to exceed two-twelfths (2/12) if the average annual usage of the applicant’s specific customer class or fifty dollars, whichever is greater. This fee may be changed by applicable statuary provisions.

Applicable in the entire service area for all new connections to the District’s distribution system except for new connections within the area formerly served by the Woods Homeowners Association, Inc.

1.Phase 1

For 365 days from the effective date of this tariff, for all new connections to the District’s distribution system there shall be paid to the District a Capacity Improvement Fee (“CIF”).  The CIF shall be paid at the time the applicant applies for a water meter and the District approves the meter installation request in accordance with District policy. 3. All CIF funds shall be maintained in a separate account administered by the District and shall be used only for upgrades to or construction of new or expanding water sources, water treatment facilities, water storage facilities and/or water transmission/distribution facilities at least 12” in diameter. 

The requested rates and charges are subject to approval by the Public Service Board of the District and the Berkeley County Council. The proposed rates are on file with and available for public inspection after January 23, 2019 at the Office of the Berkeley County Public Service Water District, located at 251 Caperton Blvd, Martinsburg 25403.

On February 11, 2019, the first reading of the water rate proposal shall occur during a Regular Meeting of the Public Service Board of the District, beginning at 5:00 pm. On February 25, 2019, the second reading of water rate proposal shall occur during a Regular Meeting of the Public Service Board of the District, beginning at 5:00 pm. All meetings of the Public Service Board shall take place at the District’s office located at 251 Caperton Blvd, Martinsburg, WV 25403. Immediately following the second reading, the District shall conduct a public hearing. Any customer desiring to protest or comment upon the proposed rate increase may attend and be heard at either meeting. Upon close of the public hearing on February 25, 2019, the Public Service Board may take action to approve the proposed rate increase and request final approval by the Berkeley County Council. Anyone desiring to file a written comment or protest may do so prior to the beginning of the public hearing on February 25, 2019. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees. 

Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder.

Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as Trustee by instrument of record.  Should any party have any inquires, objections to the sale or protests regarding the sale, or requests regarding the sale, please notify the trustee below by one of the means of communications set forth below.
